According to evidence presented in court, Fitzgerald was evicted from the premises by landlady Kirsty Allen as a result of his disruptive behavior while intoxicated. On November 27, 2022, the 31-year-old was captured on camera acting irrationally and kicking and yelling in a violent effort to re-enter the bar.
During this confrontation, Scott Fitzgerald threw a punch at a man named Leevi Francis, who had stepped outside to intervene. Francis was struck hard, breing his jaw and receiving a gash behind his eyebrow as he fell to the ground.
He was brought back inside the bar by concerned customers before being transferred to the Royal Preston Hospital for treatment. Francis had to undergo surgery to have a metal plate inserted in his jaw, resulting in ongoing pain that disrupts his sleep. The injury also prevented him from consuming solid food for a period, resulting in a weight loss of two stone.
A day after the attack, Scott Fitzgerald was eventually found at his home in Dres Croft, Ashton-on-Ribble. He first said that he had acted in self-defense, but on the first day of his trial, he entered a guilty plea to the charge of grievous bodily harm (GBH).
